You don’t need to have a contract to get paid.
In the construction sector, you do need a contract, oral or in writing or a combination of both, to be able to take your case to adjudication for a quick fix.
But if you don’t have a contract and you have done some work, or conferred some benefit and are not getting paid for it, then restitution rights in equity and in law do entitle you to be paid for the value of the benefit conferred.
Assessing the value of the benefit conferred varies, based on each case, as the assessment broadly is made from the position of the receiving party.
